Terms of Service
These Terms of Service ("Terms") govern your access to and use of Moneyka, the personal finance web application available at moneyka.cz (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.
These Terms are a separate document from the Moneyka Privacy Notice. The Privacy Notice explains how we process your personal data; these Terms explain the rules for using the Service. Where the two documents address the same topic, the more specific document governs that topic.
1. Who operates Moneyka
The Service is operated by Pavel Vlk, a self-employed sole trader registered in the Czech Republic under Business ID (IČ) 87427770 and Tax ID (DIČ) CZ8907162748, with registered address at Maršíkova 601/3, 460 06 Liberec - Liberec VI-Rochlice, Czech Republic (the "Operator", "we", "us", or "our").

2. What the Service does
Moneyka helps you record, organise, and review your own personal financial transactions. Depending on the features enabled for your account, this may include manual transaction entry, import of bank statement files that you upload yourself, categorisation and tagging, budgeting statistics, recurring transaction templates, alarms, and AI-assisted suggestions that you must review before they are saved. Moneyka does not connect directly to your bank and does not itself initiate, execute, or authorise any payment.
Where the Service offers AI-assisted features (for example, suggested categories or data extracted from an imported file), the output is a draft suggestion only. You are responsible for reviewing and confirming any AI-assisted suggestion before it is saved to your account.
3. Your account
You must be at least 18 years old and legally capable of entering into a binding contract to create an account. You may create and use only one account for your own personal use, unless we agree otherwise in writing.
You must provide an accurate e-mail address and keep your account information up to date. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us without undue delay at the contact address above if you suspect unauthorised access to your account.
The financial data you enter belongs to you. You are solely responsible for the accuracy, legality, and completeness of the data you submit, and for ensuring that you have the right to submit any data relating to another person.
4. Acceptable use
When using the Service, you must not:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- submit special-category personal data (such as health, religious, or biometric data) or personal data about another identifiable person without a lawful basis and, where required, that person's consent;
- attempt to gain unauthorised access to the Service, probe or scan its security, or interfere with its normal operation, including by introducing malware or making excessive automated requests;
- reverse engineer, decompile, scrape, or resell the Service, or use automated means to extract data from it other than the export features we provide;
- misuse AI-assisted features, including by submitting content designed to manipulate, abuse, or extract information from the underlying AI provider beyond the intended use of the feature.
We may investigate suspected violations and take appropriate action, including the suspension or termination measures described in section 7.
5. Availability of the Service
We aim to keep the Service available and to give reasonable notice of planned maintenance, but we do not guarantee uninterrupted, error-free, or continuous availability. The Service may be unavailable from time to time due to maintenance, updates, third-party provider outages, or circumstances beyond our reasonable control. We may change, add, or remove features of the Service at any time, as described in section 8.
6. Liability
Moneyka is a record-keeping and organisational tool. It does not provide financial, tax, investment, or legal advice, and any statistic, projection, alarm, or AI-assisted suggestion it produces is based solely on the data you entered and may be incomplete or inaccurate. You remain solely responsible for your own financial decisions.
To the maximum extent permitted by applicable law, the Operator's liability for damage arising from or in connection with your use of the Service is limited to actual, foreseeable damage and, in aggregate, to the amount you paid for the Service in the twelve months before the event giving rise to the claim, or to the equivalent of CZK 1,000 where the Service was used free of charge, whichever is higher.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for intentional misconduct or gross negligence, or for any other liability that Czech law does not permit us to exclude.
We are not liable for indirect, incidental, or consequential damage, loss of data, or loss of profit, except where such exclusion is not permitted by applicable law.
7. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, if you materially breach these Terms, if we reasonably suspect fraudulent, abusive, or unlawful use of the Service, or if required to do so by law. Where reasonably possible, we will give you notice and an opportunity to resolve the issue before suspending or terminating your account.
You may stop using the Service and request deletion of your account at any time, using the account deletion feature described in the Privacy Notice or by contacting us at the address above.
On termination, your right to use the Service ends immediately. We handle any personal data remaining after termination in accordance with the Privacy Notice and our published retention schedule.
8. Changes to the Service and to these Terms
We may add, modify, or remove features of the Service to improve it, to comply with legal requirements, or for operational reasons. We will try to give reasonable notice of changes that materially reduce the functionality you rely on.
We may update these Terms from time to time, for example to reflect a change in the Service, in applicable law, or in how we operate. Each version of these Terms is numbered; the current version is shown below. Where required, you will be asked to review and accept a new version before continuing to use the Service.

9. Governing law and dispute resolution
These Terms and any dispute arising out of or in connection with them or the Service, including their existence, validity, or termination, are governed by the laws of the Czech Republic, without regard to conflict-of-law rules, and without prejudice to any mandatory consumer-protection rules of the country where you have your habitual residence.
Any dispute that cannot be resolved informally by contacting us at the address above may be submitted to the competent courts of the Czech Republic, without prejudice to your right, as a consumer, to bring proceedings before the courts of your own country of residence where applicable law grants you that right.
If you are a consumer resident in the EU and we cannot resolve a complaint directly, you may contact the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) for out-of-court consumer dispute resolution, or use the European Commission's Online Dispute Resolution platform where it applies to the Service.
